Terms of Service and End User License

The short version. This summary helps you find your way; the full text below is what applies.
  • These terms are a contract between you and Tessorio LLC. By creating an account or using Tessorio, you agree to them.
  • Children under 13 can only use Tessorio through a parent's Family account or a teacher's class. Teens 13–17 need a parent's OK.
  • You own what you upload. You give us permission to use it to build and show your lessons, and nothing more.
  • Only upload material you have the right to use. We remove infringing material and close repeat infringers' accounts.
  • Lessons are made with AI and can be wrong. Check anything important. Tessorio isn't professional advice or an accredited credential.
  • Tessorio is in beta, provided "as is", and our liability is limited.

1. The agreement

These Terms of Service, including the End User License in section 5 (together, the "Terms"), govern your use of Tessorio: our website, web app, the app you can add to a phone's home screen, the lessons, videos, tutor, labs, practice tools, course library, and every related service (together, the "Service"). The Service is run by Tessorio LLC, an Arizona limited liability company ("we", "us").

By creating an account, checking the box at sign-up, or using the Service, you agree to these Terms and to the policies they include by reference: the Acceptable Use Policy, the Copyright and DMCA Policy, and How Tessorio Uses AI. Our Privacy Policy and Children's Privacy Notice explain how we handle personal information. If you don't agree, don't use the Service.

If you accept these Terms for a school, district, business or other organization, you confirm you have authority to bind it, and "you" includes that organization. A signed agreement between us and an organization (for example, a school data privacy agreement) controls where it conflicts with these Terms.

2. Who may use Tessorio

  • Under 13. Children under 13 may not create their own account. They may use Tessorio only as a learner added by a parent or legal guardian on a Family account, or by a teacher on a class account under section 4.
  • 13 to 17. Teens may create a Self-learning account only with the permission of a parent or legal guardian, who agrees to these Terms on the teen's behalf and is responsible for the teen's use.
  • 18 and over. Family, Teacher and Course Creator plans are for adults 18 and over.
  • You may not use the Service if we have previously closed your account for breaking these Terms, or if the law forbids you from using it.
  • The Service is offered to people in the United States during the beta. If you use it from elsewhere, you are responsible for following your local law.

We ask everyone's birth month and year at sign-up and keep only an age range. Giving false age information to get around these rules is a breach of these Terms.

3. Your account

  • You sign in with a one-time code sent to your email. Keep access to that email secure: whoever can read it can sign in as you.
  • A parent or teacher PIN protects the adult view on a shared device. Choose one that children can't guess. You are responsible for activity under your account, including by learners you add, unless it results from our own failure to protect it.
  • Give accurate information and keep it up to date. Don't share your account or sign in as someone else.
  • Tell us right away at support@tessorio.com if you think someone has used your account without permission.

4. Parents, teachers and schools

Parents and guardians

If you add a child to a Family account, you confirm you are their parent or legal guardian and consent to our handling of their information as our Children's Privacy Notice describes. You decide what the child can do (for example, whether they can start courses themselves), and you are responsible for supervising their use. You can review, change or delete your child's information at any time.

Teachers and schools

If you use Tessorio with students, you confirm that:

  • your school or district has authorized you to use Tessorio with your students, or you are the organization making that decision;
  • you use it only for the school's educational purposes, and where the law allows a school to consent to the collection of students' information on parents' behalf (such as under the Children's Online Privacy Protection Act), you give that consent for your school and have given parents any notice your school's policies require;
  • you add only the student information needed (a first name or nickname is enough), and never sensitive records you aren't allowed to share.

For schools, we act as a service provider under the school's direct control for student information, within the "school official" exception of the Family Educational Rights and Privacy Act (FERPA) where it applies. Student information belongs to the school. We use it only to provide the Service to the school, never for advertising, and never sell it. A school may request a data privacy agreement at privacy@tessorio.com.

5. End User License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service, including any version you add to a device's home screen, for your own learning, your family's, your class's, or (on the Course Creator plan) for building and delivering courses to your own audience as the plan allows. The Service is licensed, not sold. We and our licensors keep all rights not expressly granted.

You may not, and may not let anyone else:

  • copy, modify, translate or create derivative works of the Service's software, design or Tessorio Library courses, except as the Service itself allows (such as making your own copy of a shared course);
  • reverse engineer, decompile or try to extract source code, models, prompts or underlying ideas, except where the law expressly permits it despite this restriction;
  • rent, lease, resell, sublicense or offer the Service to others as a service bureau or white-label product;
  • use bots, scrapers or other automated means to access, copy or extract content or data, or to create accounts;
  • get around usage limits, plan limits, access controls, age checks, or security measures;
  • use the Service or its output to build or train a competing product or AI model;
  • remove or change any copyright, trademark, license credit or AI label.

We may update the Service at any time. Updates are covered by this license. Some features are experimental and may change or be removed.

6. Your content

"Your Content" means what you or learners on your account put into the Service: files and pictures you upload, notes and curricula you paste, course requests, answers, tutor messages, practice work, and similar material.

  • You keep ownership. As between you and us, you own Your Content.
  • What you let us do with it. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt, translate, and display Your Content only to operate, secure and improve the Service for you: for example, to read an uploaded PDF, write lessons from it, narrate and illustrate those lessons, and show them to you and the people you share with. This includes sending it to the service providers listed on our Service Providers page. It ends when you delete the content or your account, except for copies others already made of courses you shared (below), and backups kept for a limited time under our Privacy Policy.
  • We don't train AI on learners' content. We don't use content from learners, or information about them, to train AI models, and we route it only to AI providers that have agreed not to keep it or train on it. See How Tessorio Uses AI.
  • Sharing. Courses are private unless you turn on sharing or publish them. When you share a course, you grant other users a license to view it and to make their own copy in Tessorio, which the Service may rebuild for how they learn, for personal or educational use within Tessorio. If you stop sharing, new people can't open it, but copies already made stay with the people who made them.
  • Feedback. If you send us ideas or suggestions, we may use them without owing you anything.

7. Your promises about uploads

When you upload, paste, build from, or share anything, you confirm that:

  • you own it, or have all the permissions needed to use it this way, including to let us process it with AI and turn it into lessons, and to share it if you turn on sharing;
  • it doesn't infringe anyone's copyright, trademark, privacy, publicity or other rights. Textbooks, paid courses, workbooks, test banks and other people's videos are usually copyrighted: uploading them without permission may be infringement even when it's for your own study, and sharing a course built from them is not allowed;
  • it doesn't include other people's personal information without their permission, or sensitive information such as health records, Social Security numbers, financial account details, or a student's special-education or disciplinary records;
  • it follows our Acceptable Use Policy.

We don't review uploads before they are processed, and we aren't responsible for Your Content. We may remove, disable, or refuse to process any content, and suspend sharing, if we believe it breaks these Terms or the law, or if we receive a complaint about it.

8. AI-made content

  • Lessons, narration, pictures, tutor answers, practice questions, grades on practice, labs and course plans are generated by AI, sometimes from your material. AI can be wrong, incomplete, out of date, or biased, and can occasionally produce something that resembles existing work.
  • Check anything important against a trusted source. The Service is for learning. It is not medical, legal, financial, tax, safety, mental-health or other professional advice, and it does not replace a qualified teacher, licensed training, or a professional's judgment. Never rely on it for safety-critical work.
  • As between you and us, you may use the lessons built for you for the purposes these Terms allow. Similar content may be generated for other users, and AI output may not be protected by copyright.
  • Progress, readiness checks, scores and certificates of completion show activity in Tessorio only. They are not accredited credentials, grades from a school, or proof of competence or licensure, and we don't promise any learning, test or career result.
  • Narration uses a synthetic voice, and generated pictures are labelled as generated.

9. Our content and others' content

The Service, the Tessorio name and brain logo, the Tessorio Library courses, and our software, designs and text belong to us or our licensors and are protected by law. Some lessons show photos or diagrams from Wikimedia Commons and other free-license sources, credited on screen; those remain under their own licenses, which apply if you reuse them outside Tessorio. Links to other websites are provided as a convenience; we don't control them and aren't responsible for them.

10. Copyright complaints and repeat infringers

We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act. How to send a notice or counter-notice is in our Copyright and DMCA Policy. We close, in appropriate circumstances, the accounts of users who repeatedly infringe.

11. Plans, beta and fees

  • Tessorio is in beta. Every plan is currently free. Features, limits (such as lesson length, number of builds, or AI practice), and availability may change, and the Service may be unavailable at times.
  • If we introduce paid plans, we will show the price, billing period, renewal and cancellation terms before you agree to pay, and we will not charge you without your agreement. Paid plans will be governed by these Terms plus the terms shown at purchase.

12. Services from other companies

The Service relies on other companies for hosting, sign-in, AI models, voice and images. Your use of features that depend on them may also be subject to their terms. We aren't responsible for services we don't control, but we choose them carefully and list them on our Service Providers page.

13. Suspension, termination and deleting your account

  • You may stop using the Service at any time and ask us to delete your account at privacy@tessorio.com.
  • We may suspend or close your account, or limit features, if you break these Terms, if needed to protect learners, other users, us or the public, if the law requires it, or if we stop offering the Service. Where reasonable, we will tell you first and let you download your content.
  • Sections 6 (feedback and copies already made), 8, 9, and 14 through 18 survive after these Terms end.

14. Disclaimers

To the fullest extent the law allows, the Service and all content, including AI-made content, are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, title and non-infringement. We don't promise that the Service will be uninterrupted, secure, error-free, or that content will be accurate or suitable for any purpose.

15. Limitation of liability

To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to the Service or these Terms, even if we were told they were possible. Our total liability for all claims relating to the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the claim or one hundred US dollars ($100).

Some places don't allow these limits, so they may not all apply to you. Nothing in these Terms limits liability that can't be limited by law, such as for fraud or intentional misconduct.

16. Responsibility for claims

To the extent the law allows, if you are an adult or an organization, you will defend and compensate us for third-party claims, losses and costs (including reasonable lawyers' fees) that arise from Your Content, your breach of these Terms, or your violation of anyone's rights. We will tell you about the claim promptly and let you control its defense.

17. Disputes and governing law

  • Before filing a claim, contact us at legal@tessorio.com and give us 30 days to try to resolve it informally. Most concerns can be resolved this way.
  • These Terms are governed by the laws of Arizona and applicable US federal law, without regard to conflict-of-law rules. Any dispute that isn't resolved informally will be decided exclusively in the state or federal courts located in Maricopa County, Arizona, and both of us consent to their jurisdiction. Either of us may bring an individual claim in small-claims court instead.

18. Changes to these Terms

We may update these Terms. If a change is significant, we will tell you in the app or by email before it takes effect and ask you to agree again; if you don't agree, you may stop using the Service and delete your account. Each document shows its effective date and version.

19. General

These Terms, and the documents they refer to, are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we don't enforce a part, that isn't a waiver. You may not transfer these Terms without our consent; we may transfer them with our business, and your information stays protected as our Privacy Policy describes. We aren't responsible for delays caused by events beyond our reasonable control. You may not use the Service in violation of US export control or sanctions laws.
